BOOK A CLEANING

TERMS OF SERVICE

By using, AccessMaids.com website or ordering services over the phone, email you accept and agree to be bound by this Customer Service Agreement.


1. AccessMaids' obligations

A. In accordance with the conditions of this Agreement, AccessMaids Inc commits to providing cleaning services (referred to as the "Service") to the Customer at a location specified by the Customer (known as the "Premises").

B. The Service will be for cleaning duties at the time of reservation.

C. AccessMaids will dispatch the cleaners to attend the Premises to provide the Service at a time and date mutually agreed between AccessMaids Inc and the Customer (the "Service Time").

D. AccessMaids endeavors to provide the Service faithfully, diligently and in a timely and professional manner.


2. Customer obligations

A. Provide a safe working environment at the Premises for the Cleaners to perform the Service;

B. Provide unencumbered and unobstructed access to those areas of the Premises requiring the Service;

C. Provide the Cleaners with access to all utilities including hot, cold water and electricity;

D. Advise AccessMaids Inc prior to the commencement of the Service of any hazards, risks or dangers, ingrained dirt at the Premises.

E. Remove any fragile, delicate, breakable or valuable items, including cash, jewelry, works of art, antiques or items of sentimental value prior to the commencement of the Service.

F. Notify AccessMaids' office if there are any faulty installed doors, windows, shelving, mirrors, cabinets which may fall upon contact.


3. Website access

A. In order to access some features of the Website, you agree to create an account and to be responsible for the activity that occurs on your account.

B. You agree to notify AccessMaids Inc immediately of any breach of security or unauthorized use of your account.

C. You agree the information you have provided is current, accurate, truthful and complete.

D. You agree to notify AccessMaids of any change to the account-related information 36 hours before the appointment.


4. Alerts

A. You agree to receive email or text message confirmations and alerts which are active by default as part of the service. 

B. You agree that any alerts provided to you may be delayed by a variety of factors, such as hosting company or email server delays.

C. You agree that AccessMaids Inc shall not be liable for any delays, failure to deliver, or misdirected delivery of any confirmation or alert; for any errors in the content of a confirmation or alert.


5. Cleaning estimates and hourly based pricing

A. You agree that the actual price payable is calculated on the total number of hours and minutes worked by the Cleaners.

B. Any price estimates are based on AccessMaids' prior experience, without inspection, and based on information provided by the Customer.

C. If at the commencement or during the course of providing the Service, it is apparent that the actual cost of the Service will exceed the quote provided by AccessMaids Inc, AccessMaids will provide the Customer with the option to pay an increased fee to complete the Service or pay the quoted amount without the Service being completed.


6. Reservations

A. The Customer agrees to provide AccessMaids Inc with their valid credit/ debit card details at the time of reservation and authorizes to debit any card with an amount equal to any service and/ or cancellation fees that may apply under this Agreement.

B. AccessMaids reserves the right not to accept a reservation for any reason.

C. Customer agrees the payment details will be kept on file for future reservations.


7. Payment terms

A. The Customer agrees to pay AccessMaids Inc in full when the Service is complete, unless otherwise agreed in advance.

B. You authorize to charge the credit card on file.


8. Late payment fee

A. Where AccessMaids Inc has agreed to invoice the Customer for payment of fees after the Service has been completed, the Customer agrees to pay in full, all fees due, within 3 days of the invoice date.

B. The Customer agrees that if AccessMaids Inc has not received payment in full for the Service within one calendar month of the original invoice date to pay $89 late payment fee.

C. In addition to the amounts set out above, the Customer agrees to reimburse AccessMaids Inc for all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by AccessMaids Inc in connection with a demand, action, or other proceeding (including mediation, out of court settlement or any action taken for recovery of debt from the Customer) arising out of a breach of these terms including the failure by the Customer to pay an amount by the due date.


9. Complaints and refunds policy

A. You agree to inform AccessMaids Inc via email support@accessmaids.com within 48 hours if you are dissatisfied for any reason with the Service provided.

B. You agree to select one of the next available days for a free re-cleaning of the problem areas.

C. You acknowledge that AccessMaids Inc does not provide monetary refunds, but instead offers a free re-cleaning service.

D. You agree to pay in full forservices performed by AccessMaids Inc prior to re-cleaning.


10. Minimum order policy

A. You agree that the minimum order policy for Basic cleaning, Deep is 2 hours for 2 maids crew (equal to 4 man-hours). For Move in/out cleaning minimum order is 2 hours 30 minutes/ 2 maids crew (equal to 5 man hours). After remodeling cleaning is 16 cleaning hours (2 maids for 8 hours).


11. Personnel

A. You agree that AccessMaids Inc reserves the right so send one, two or three maids crew to complete order.


12. Cancellations and Rescheduling

A. The Customer agrees to provide AccessMaids with at least 24 hours notice prior to the Service Time to suspend, postpone or cancel the Service for any reason.

B. If the Customer cancels or reschedules less than 24 hours before the appointment time, Customer agrees to reimburse $90.
Late cancellation fee for after remodeling cleaning is $300.
C. Customer agrees to cancel or reschedule the Service via online reservation system (customer portal).


13. Fee for non-access to premises

A. In the event that the Customer does not provide access the Premises for Cleaners to provide the Service, the Customer agrees to reimburse the reserved time cost/ minimum order fee.


14. Arrival times

A. Customer agrees there is 30 minutes arrival window for 7:30 am appointments, 60 minutes for reservations from 10 am, 2 hours starting from 2pm.


15. Pricing

A. Flat-rates pricing: We are unable to provide a discount when the maids finished the task in less time than expected.
B. Customer agrees all estimates are approximate and the actual cleaning time may vary.


16. Start/ Finish Times

A. Customer agrees the arrival time starts from the minute the cleaning crew enters your building. All completion times are rounded to the nearest 15 minutes. 


17. Laundry service 

A. Customer agrees all items for dry cleaning will be put away and are not mixed with clothes for regular wash, or stored nearby in an unmarked bag/ hamper that might be confused with clothes for washing.

B. Customer agrees to either collect and sort the wash or provide AccessMaids office with specific instructions if any. Mark/ separate items that should not be placed in the dryer and instruct where to place/hang them.

C. Customer agrees to leave enough laundry detergent, bleach, softener, laundry card or cash to load on the card if needed or sufficient amount of quarters. Also, to inform of laundry room location and any special regulations.


18. Recurring service pricing

A. We reserve the right to increase recurring service rate up to 5% a year to cover rising labor and fuel costs.


19. Pets policy

A. At our cleaning company, we understand that pets are important members of your family and we are happy to accommodate them.
To guarantee the safety of our employees, we advise our team not to enter a property if they suspect a pet may be dangerous, as pets may act differently when their owners are not present. If a maid must be removed from a home due to aggressive pets, our cancellation policy will be enforced.


20. Breakage, Damages and Loss Policy
A. Our cleaning company takes great care when cleaning your home, and while breakage or damage is rare, it is a possibility. To ensure your peace of mind, we carry insurance for any damage or breakage that may be caused by our cleaners.

However, we would like to note that we cannot be held liable for damage resulting from normal wear and tear, or due to the improper installation of an item in your home. Additionally, any artwork, collectibles, or family heirlooms not disclosed during the booking process are also excluded from our liability. We highly recommend that clients notify us of such items before starting service, and provide instructions on how to handle and care for them.

In the event that personal items are broken or lost during our cleaning service, we request that you notify us within 24 hours. Although we will attempt to replace the item with an identical one, we cannot guarantee an exact match. We understand that these items may be valuable and irreplaceable, and we want to work with you to ensure their proper care and protection.


21. Non-Solicitation Policy
To ensure the integrity of our business and our employees, we kindly request that our customers refrain from soliciting our cleaning staff for direct hire. Our professional cleaners undergo a thorough screening process, which includes background checks and reference verifications. Additionally, they undergo comprehensive cleaning training, and we invest significant time, resources, and money into each new employee before allowing them to enter our customers' homes.

We value our employees and their contributions to our company, and we believe that their continued employment with us is in the best interest of both parties. Therefore, we kindly request that our customers respect our non-solicitation policy and not attempt to hire our employees directly.



22. Intellectual property rights

A. The content on the AccessMaids' Web-site, except all User Submissions, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features are owned by or licensed to AccessMaids', subject to copyright and other intellectual property rights under United States and foreign laws and international conventions.

B. Content on the Web-site is provided to you as is for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.


23. Exclusions and limitations

AccessMaids Inc does not offer the following tasks:

Moving heavy items, outdoor work, polishing hardwood floors, removal of pets and bodily fluids, mold or infestation removal, deep stain removal, wet-wiping light bulbs, cleaning of chandeliers, backyards, and exterior windows or cleaning of areas outside of normal reach or areas above the reach of our 3-foot step ladder.

AccessMaids Inc is not responsible for:

A. Existing dirt, wear, damage or stains that can not be completely cleaned or removed.

B. Any wear or discoloring of fabric or surfaces becoming more visible once dirt has been removed.

C. The cost of any key replacement or locksmith fees, unless keys were lost by AccessMaids Inc.


24. Indemnity

The Customer indemnifies AccessMaids Inc against :

A. All losses or liabilities arising directly or indirectly as a result of the provision of the Service including all losses or liabilities caused as a result of a breach of the warranties of the Customer set out in clause 2; and

2. All legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by AccessMaids Inc in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal and including any action taken for the recovery of a debt from the Customer).


25. Changes to this agreement

A. AccessMaids Inc reserves the right to update or modify these terms and conditions at any time without prior notice, and may do so by publishing an updated agreement on its website. Each updated agreement will take effect 24 hours after it has been published on the website.

B. The Customer agrees that any use of the Service following any such change, whether as a single job or as part of a regular cleaning schedule, constitutes their agreement to follow and be bound by the terms and conditions as changed.


26. Termination

A. This Agreement may be terminated by the Customer by providing at least 36 hours notice prior to the Service Time


27. Arbitration
In the event of any dispute between the parties arising out of or related to this Agreement, including any claims of breach of contract, tort or violation of statutory rights, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the parties are unable to resolve the dispute through negotiation, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Niles, Illinois, The award of the arbitrator shall be final and binding, and judgment upon the award may be entered in any court having jurisdiction thereof.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois.
